How Does it Work?
Based on a National Trademark Registration or EU Trademark
Before submitting an international application, you must have a base, which can be a national trademark registration or an EU Trademark, or an application for either. If you already have a UK trademark or application, you can expand it to other countries using the Madrid System.
If you have a national trademark registration or an application in a Madrid System member country, we can assist you in extending it into the relevant authority. The information in your national trademark registration and international application must correspond. You may then apply for international trademark registration for all goods and services, but only for the same or fewer categories.
Online Filing
To submit an international application based on your local trademark, send it online via UKIPO, selecting the countries you want to cover. UKIPO will then forward it to WIPO. Due to Brexit, EU trademarks and international applications involving the EU are subject to specific measures, including automatic conversion of registered trademarks.
If you submit your international application within six months of submitting the UK trademark, you can request priority, ensuring trademark protection on the same date in all countries included in your application.
Assessment by WIPO
The World Intellectual Property Organization reviews your application to ensure it meets the necessary conditions. Once completed, your application is recorded in the international database and published in the WIPO Gazette of International Marks. WIPO informs the relevant authorities in the countries where you have submitted your application.
Individual Examination
Each country will examine your application independently. Your trademark could be:
UKIPO has no control over this procedure and does not have access to your application status. You may use Trademark World’s Madrid Monitoring service for updates. In certain countries, including the US, it is required to appoint an IP representative for communication with authorities.
